Introduction and Acceptance

THIS IS AN AGREEMENT BETWEEN YOU OR THE ENTITY THAT YOU REPRESENT (hereinafter 'You' or 'Your') AND LOG E INFOTECH PVT. LTD., Product of MEDISEVAS (hereinafter 'Log e Infotech Pvt. Ltd.') GOVERNING YOUR USE OF LOG E INFOTECH PVT. LTD. SUITE OF ONLINE APPOINTMENT AND OTHER HEALTHCARE SOFTWARE (hereinafter 'Log e Infotech Pvt. Ltd. Service(s)').

Parts of this Agreement

This Agreement includes the following terms and conditions (referred to as the 'General Terms') and any specific terms and conditions related to the use of individual Services (referred to as the 'Service Specific Terms'). Together, the General Terms and Service Specific Terms are referred to as the 'Terms'. If there is a conflict between the General Terms and the Service Specific Terms, the Service Specific Terms will take precedence.

Acceptance of the Terms

You must be of legal age to enter into a binding agreement to accept the Terms. If you do not agree to the General Terms, please refrain from using any of our Services. If you agree to the General Terms but do not agree to any Service Specific Terms, do not use the corresponding Service. You can accept the Terms by checking a checkbox or clicking on a button that indicates your acceptance of the terms or by using the Services.

The information you obtain or receive from Log e Infotech Pvt. Ltd., and its employees, contractors, partners, sponsors, advertisers, or otherwise on the Site is for informational and scheduling purposes only.

Service Use, Responsibilities, and Information

Registration

As part of the registration process, you will need to provide an email address, mobile number, and create a password. These will serve as your access credentials for the Services available exclusively to members ("Credentials"). It is important to keep your Credentials confidential and not share them with others. Doctor, Appointment and patient registration

We do not provide any guarantees, representations, or warranties, whether expressed or implied, regarding professional qualifications, expertise, quality of work, or any other information presented here. Additionally, we do not endorse any individual mentioned herein. We shall not be liable to you or any other party for any decisions made or actions taken based on this information.

We cannot control or guarantee the availability of any physician at a specific time. We are not liable for cancelled or otherwise unfulfilled appointments, any resulting injuries, or any other injuries that may occur from the use of the Site or Services.

It is advisable to conduct your own research before choosing a health care professional. This includes making phone calls to the relevant licensing authorities to verify credentials and education. Additionally, you should confirm information about a specific physician or medical provider by checking with the doctor's office, your current physician, the medical association related to the doctor's specialty, and your state medical board.

Authorization and Acknowledgement

In relation to the use of the Site and the Services for finding and arranging appointments with healthcare providers, you acknowledge that:

Log e Infotech Pvt. Ltd. chooses physicians or medical providers to be highlighted on the Site based on an existing contractual agreement with them.

Log e Infotech Pvt. Ltd. will supply you with a list of physicians or medical providers who may be appropriate for the health care you are seeking, based solely on the information you provide to Log e Infotech Pvt. Ltd. (including specialty, proximity to your location, and any other criteria you specify). Ultimately, you are responsible for selecting your own physician or medical provider.

Information Presentation/Editorial Control

The Site is provided as a service to consumers and healthcare professionals to offer an informative and educational resource. While we may have non-user-posted information reviewed by the Site's editorial staff, we are not obligated to do so.

The timeliness and accuracy of the information provided are not guaranteed. The authors, editorial staff, and any other individuals involved in the preparation or publication of this work cannot ensure that the information contained is entirely accurate or complete. They are not responsible for any errors or omissions, or for the outcomes resulting from the use of this information.

PROCEDURES/PRODUCTS/SERVICES:The procedures, products, services, and devices mentioned or advertised on the Site are not suitable for all individuals, patients, or clinical scenarios. We do not guarantee the effectiveness of any such procedures, products, services, or devices. Any products and services showcased on the Site by advertisers, sponsors, and other participants, whether they are paid or unpaid, are provided for information purposes only and do not imply suitability for any specific individual or predict effectiveness, outcomes, or success.

Personal Information, Responsibilities, and Usage

Your Personal Information

To register, you are required to provide certain personal and medical information about yourself. You may voluntarily submit and authorize Log e Infotech Pvt. Ltd., along with its employees, agents, and others acting on its behalf, to use and/or disclose personal and health-related information about you. Ltd. or provided by you (referred to as 'Personal Information'). You have the right to refuse to authorize the use and/or disclosure of your Personal Information. Although the Services are offered at no cost, the standard fees for any medical services provided by the collaborating physicians listed on the Site will apply and will be your sole responsibility.

You are accountable for all usage of the Site and your Credentials, including any usage by others to whom you have provided your Credentials. The Site and the Services may only be used for lawful, non-commercial purposes. You must not use the Site in any way that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's ability to use and enjoy the Site or the Services. You are also prohibited from attempting to gain unauthorized access to any of the Services, user accounts, or computer systems or networks, through hacking, password mining, or any other means. Additionally, you agree that you will not (and will not permit any third party to):

Copy, modify, adapt, translate, or reverse engineer any part of the Site, its content or materials, and/or the Services;

Eliminate any copyright, trademark, or other proprietary rights notices found in or on the Site and/or the Services, or in or on any content or other materials acquired through the Site and/or the Services.

illegitimately use the Services by making an appointment with a physician that you do not intend to attend;

create user accounts through automatic methods or under misleading or deceptive circumstances; or

Gather or retain personal information about other users in relation to the activities that are not allowed as outlined in this section.

We may take legal action and use technical measures to prevent violations of this provision and enforce these Terms of Use, in addition to our rights outlined in these Terms.

Changes, Updates, and Fees

Changes to These Terms of Use

We may modify these Terms of Use at any time, as we find suitable. When changes are made, the updated agreement will be posted on the Site, along with a notice of the revisions. Your continued use of the Site and/or the Services after such notification will indicate your acceptance of the Terms of Use, including the modifications, and your agreement to comply with the amended Terms of Use. Fees and Payments

Subscriptions for paid services are offered on annual plans. Your subscription will automatically renew at the end of each period unless you notify us that you do not wish to renew. The subscription fee will be charged to the last credit card you used. If you prefer to use a different credit card for the renewal or do not wish to renew the subscription, you must inform us at least seven days before the renewal date. Upon termination of the subscription, you will be refunded the subscription fee for any unused portion of the subscription period. Log e Infotech Pvt. Ltd. reserves the right to modify the subscription fee and to introduce charges for services that are currently free of charge. You will not incur any charges for a service unless you have chosen a paid subscription plan. Restrictions on Use

In addition to all other terms and conditions of this Agreement, you shall not: (i) transfer or otherwise make the Services available to any third party; (ii) provide any service based on the Services without prior written permission; (iii) use third-party links to sites without agreeing to their website terms and conditions; (iv) post links to third-party sites or use their logo, company name, etc., without their prior written permission; or (v) use the Services for spamming or other illegal purposes.

No Spam

You are not permitted to use contact information provided by our users or collaborating physicians, nor to collect such information for the purpose of sending or facilitating unsolicited bulk communications, including SPAM. You must not permit others to use your account in a manner that violates the terms of this section. We reserve the right to terminate your membership or access to the Site immediately and take other legal actions if you or anyone using your Credentials breaches these provisions.

Additional Terms

Some Services available on the Site may include additional terms, such as policies, guidelines, and rules, that will further regulate your use of those specific Services and complement these Terms of Use. If you decide to register for or access any of these Services, you will be provided with the relevant additional terms and conditions at that time. By using those Services, you agree to adhere to these additional guidelines and rules.

When providing feedback, please ensure that your comments about the doctor and your experiences are clear and honest, while avoiding inappropriate language, unnecessary personal criticisms, or information that could reveal your identity. While participating in other interactive or community features of the Service, refrain from posting any information that might allow another user or physician to identify you, but do include all relevant information in a concise way to assist us in providing a helpful response.

We reserve the right to publish your Posted Information as part of the Service and to remove your Posted Information for any reason. However, we are not responsible for any failure or delay in removing Posted Information. Please note that the Posted Information of others reflects only their opinions and should not be relied upon. Additionally:

You are responsible for any information that you submit, publish, or display on the Site, or transmit to other members and users of the Site.

You are prohibited from posting, distributing, or reproducing any copyrighted material, trademarks, or other proprietary information without prior written consent from the owner of those rights. Additionally, you may not submit any content or material that infringes upon, misappropriates, or violates the intellectual property, publicity, privacy, or other rights of any individual or entity.

General Limitation of Liability

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US IS THE CANCELLATION OF YOUR REGISTRATION. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO OR ARISING OUT OF YOUR USE OF THE SERVICES OR THE SITE, REGARDLESS OF THE FORM OF ACTION, EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF FEES, IF ANY, THAT YOU PAID TO UTILIZE THE SITE OR THE SERVICES OR (B) Rs1. Termination, Assignment, and Electronic Contracting

Termination

We reserve the right to terminate or suspend your registration immediately and without notice if there is a violation of these Terms of Use or any other policies and terms posted on the Site, whether by you or by someone using your Credentials. Additionally, we may cancel or suspend your registration for other reasons, including prolonged inactivity, but we will make an effort to notify you prior to such actions. Log e Infotech Pvt. Ltd. will not be liable to you or any third party for any termination of your access to the Site or the Services. Furthermore, you agree not to attempt to use the Site or the Services after any deletion, deactivation, or termination. Sections 2, 4, 14, 16, 17, 18, 19, 20, and 22 through 25 will remain in effect following any termination or expiration of these Terms of Use.

Indemnification

Upon your request, you agree to defend, indemnify, and hold us, along with our employees, contractors, officers, directors, agents, parent companies, other affiliated entities, and suppliers, harmless from all liabilities, claims, demands, and expenses, including attorney's fees, made by any third party that arise from or relate to (a) your access to the Site, (b) your use of the Services, or (c) your or any third party's use of your Credentials in violation of these Terms of Use or any intellectual property or other rights of any person or entity. This indemnification obligation does not apply to liabilities, claims, and expenses resulting from our own gross negligence or intentional misconduct.

Electronic Contracting and Notices

By using this Site and/or registering for the Site or Services, you are providing your electronic signature to these Terms of Use and consenting to enter into agreements with us electronically.

Log e Infotech Pvt. Ltd. has established a general policy regarding copyright infringement. The contact information for Log e Infotech Pvt. Ltd.'s Designated Agent to Receive Notification of Claimed Infringement ("Designated Agent") is included at the end of this section.

Log e Infotech Pvt. Ltd. Policy

It is the policy of Log e Infotech Pvt. Ltd. to (a) block access to or remove materials that, in good faith, are believed to be copyrighted materials that have been illegally copied and distributed by any advertisers, affiliates, content providers, members, or users; and (b) remove and discontinue service to individuals who repeatedly violate this policy.

Procedure for Reporting Copyright Infringements.

If you believe that material or content on the Site or accessible through the Services infringes a copyright, please send a notice of copyright infringement including the following information to the Designated Agent listed below ("Proper Bona Fide Infringement Notification"):

A signature, either physical or electronic, of an individual authorized to represent the copyright owner whose rights have been reportedly violated.

Identification of the works or materials that are being violated.

Identification of the material that is alleged to be infringing, including details about the location of the infringing materials that the copyright owner requests to be removed, with enough information for Log e Infotech Pvt. Ltd. to locate and verify its existence.

Contact information for the notifier, including address, phone number, and, if applicable, email address.

A declaration that the notifier genuinely believes that the material is not authorized by the copyright owner, its agent, or the law; and

A declaration made under penalty of perjury affirming that the information provided is correct and that the notifying party is authorized to file the complaint on behalf of the copyright owner.

Upon Receipt of a Bona Fide Infringement Notification.

Upon receiving a proper bona fide infringement notification by the designated agent, it is the policy of Log e Infotech Pvt. Ltd.

• to eliminate or deactivate access to the material in question;
• to inform the content provider, member, or user that access to the material has been removed or disabled;
• For repeat offenders, Log e Infotech Pvt. Ltd. will terminate the access of the content provider, member, or user to the service.

Procedure to Supply a Counter-Notice to the Designated Agent.

If the content provider, member, or user believes that the material that was removed or to which access was disabled is not infringing, or that they have the right to post and use such material from the copyright owner, the copyright owner's agent, or in accordance with the law, they must submit a counter-notice to the Designated Agent listed below, including the following information:

• A signature, either physical or electronic, of the content provider, member, or user;

• Identifying the material that has been removed or to which access has been disabled, as well as the location where the material was previously available.

• A declaration from the content provider, member, or user indicating a genuine belief that the material was removed or disabled due to an error or incorrect identification of the material; and

• The name, address, telephone number, and, if applicable, email address of the content provider, member, or user, along with a statement indicating that the individual or entity consents to the jurisdiction of the Federal Court for the judicial district where the address of the content provider, member, or user is situated. If the address is outside the United States, the consent applies to any judicial district where Log e Infotech Pvt. Ltd. is located, and the individual or entity agrees to accept service of process from the person who notified them of the alleged infringement.

Removal

If a counter-notice is received by the Designated Agent, Log e Infotech Pvt. Ltd. may forward a copy of the counter-notice to the original complaining party, informing them that the removed material may be restored or access to it may be restored within 10 business days. Unless the copyright owner takes legal action against the content provider, member, or user, the removed material may be put back or access to it may be reinstated in 10 to 14 business days or longer, at the discretion of Log e Infotech Pvt. Ltd.

General Terms and Legal Information

Entire Agreement

These Terms of Use, along with any additional terms, policies, rules, and guidelines posted on the Site, including the Privacy Policy, represent the complete agreement between you and us, replacing all prior written or oral agreements. If any section of these Terms of Use is deemed invalid or unenforceable, that section will be interpreted in a way that aligns with applicable law, reflecting the original intentions of the parties as closely as possible, while the remaining sections will continue to be in effect. The failure of Log e Infotech Pvt. Ltd. to assert or enforce any right or provision within these Terms of Use does not waive that right or provision. Additionally, the failure of either party to exercise any right herein shall not be considered a waiver of any further rights.

Choice of Law and Dispute Resolution

These Terms of Use will be considered as having been established and will be interpreted and enforced in accordance with the laws of the State of Tamil Nadu, applicable to contracts made and performed entirely within Chennai, without consideration of the state's conflict of law provisions. Any controversy, dispute, or claim arising from or related to these Terms of Use or the use of the Services will be resolved through final and binding arbitration conducted by an arbitration tribunal in the State, City, and Jurisdiction of Chennai, Tamil Nadu. The arbitration tribunal will consist of one arbitrator. The arbitrator’s decision or award will be final, and judgment on such decision or award may be entered in any competent court, or a competent court may be approached for judicial recognition and enforcement of the decision or award. The parties acknowledge that the arbitrator has the authority to impose equitable and injunctive relief as well as to award monetary relief, as deemed appropriate by the arbitrator.

Assignment

This contract can be assigned at any time to any parent, subsidiary, or affiliated company, or as part of the sale, merger, or other transfer of our company to another entity. A notice regarding any change of ownership will be posted on the Site, allowing you the opportunity to discontinue your use of the Site or cancel your registration if you prefer not to continue using the Site and the Services under the new ownership. The Site is operated in India and is intended for Indian users; using it outside of India is at the user's own risk, and users are responsible for adhering to any local laws relevant to their use of the Services or the Site
